Legalization Process
WHY DOCUMENT NEEED TO BE LEGALIZED?
Pursuant to Clause 2, Article 2, Decree 111/2011, Consular legalization means the competent Vietnamese agencies’ certification of stamps, signatures and titles on foreign papers and documents for being recognized and used in Vietnam.
Foreign Direct Investment (FDI) in Vietnam involving with IRC and ERC is required legalized document at the application stage.
LEGALIZATION PROCESS FOR DOCUMENT TO BE USED IN VIETNAM
The legalization process of foreign-issued document (to be used in Vietnam) differs from country to country. The Company should contact with the Vietnamese Embassy/Consulate in their home country for the specific instruction and requirement.
Basically, the “legalization process” of a document involves in following steps:
- Notarization | This is the attestation by a Notary Office that the signature appearing on the document is true and genuine or the documents are true copies
- Authentication | The Ministry of Foreign Affairs certifies the documents
- Legalization | The Vietnamese embassy/consulate where the document is to be presented can now declare and accept the signature, seal or stamp appearing on the document as genuine
The final target of legalization process is to obtain the stamp sticker of Vietnam Embassy in the host country.
Legalized document is translated into Vietnamese and arranged for notarization for purpose of application submission.
